Terms of Use for Online Surveys on Household Tests

 

1. Contracting parties

These Terms of Use apply between yourself (user) and BSH Hišni aparati d.o.o. Nazarje, Savinjska cesta 30, 3331 Nazarje (BSH).

 

2. Terms for participating in surveys that do not require any registration/user account

Users are obliged to provide truthful information in surveys. Intentional and grossly negligent misstatements shall entitle BSH to exclude the user from participating in online surveys on household tests and, in the event of repeated violation, closing any existing user account as well.

 

3. Terms for participating in surveys that require registration/a user account

If participating in online surveys on household tests requires registration and the related creation of a user account, the following provisions shall apply:

Persons permitted to participate in online surveys on household tests are natural persons of legal age who reside in the Republic of Slovenia unless they belong to the following group of persons:

  • employees and authorised persons of business partners of BSH Hišni aparati d.o.o. Nazarje and its affiliated companies
  • officials (politicians, journalists of public service broadcasters etc.)

Legal entities such as companies and associations are excluded from participation.

 

3.1 Selection procedure

Completion of the registration process and the related creation of a user account shall not entitle the user to participate in a household test. Registration is the requirement for participating in a selection procedure to participate in a household test.

The selection procedure to participate in a household test involves one or several surveys concerning the user’s personal circumstances in order to determine the user’s suitability for participation in a household test. The decision on whether to offer a user the opportunity of participating in a household test is an individual decision by BSH which also includes soft factors which are not objectively verifiable. A user shall have a right to participate in a household test only upon receipt of a corresponding notification from BSH.

Participation in a household test requires the conclusion of a written contract stipulating further details.

Users who are not offered the opportunity of participating in a household test by BSH can either

  • delete their user account in the account area themselves; or
  • not delete their account and in doing so declare to BSH that they are available to participate in household tests in the future (candidate pool).

 

3.2 Obligations in relation to the user account and accuracy of data

When registering, the user has to provide truthful information. Users are not permitted to register with information which does not apply to the user (registration under another name) or with fictitious information (as a joke) and this can result in the user account being deleted and re-registration blocked.

BSH has the right at reasonable intervals to request the user via the email address specified in the user account to verify the accuracy of contact and master data (see Privacy Statement) and, if necessary, update data or confirm their accuracy.

BSH has the right without prior notification to delete users who have not updated their personal details for 6 months (inactive users).

 

3.3 Obligation to participate in online surveys

BSH has to right to request users to participate in surveys until further notice. The purpose of this is:

  • to update participant data;
  • to carry out surveys for market research purposes and to improve products and their suitability for use.

 

4. Change of Terms of Use

BSH has the right to adapt these Terms of Use to changed circumstances. In such case, the changed Terms of Use shall be provided to the user with a reference to their updating, and requesting the user to consent to the changed Terms of Use. If consent is not given, this service may no longer be used (after the end of a waiting period).

 

5. Applicable law

These Terms of Use are governed by the law of the state in which you habitually reside, to the exclusion of conflict-of-law rules of that state and the UN Sales Convention.
